Understanding child car seat laws can feel confusing — especially as safety regulations evolve. But choosing the right seat and using it correctly is one of the most important things you can do to protect your child on the road. It also helps you avoid penalties, as using an unsuitable or incorrectly fitted seat can lead to a £500 fine.

This guide breaks down the current rules in simple, parent‑friendly language so you can travel confidently and safely.

The law: When children must use a car seat

Under UK law, a child must use a car seat until:

  • They are 12 years old, or
  • They reach 135cm in height.

All children grow at different rates, so it’s simply whichever comes first.*

In the Republic of Ireland, the requirement is higher: 150cm or 36kg.

Only EU-approved seats are legal in the UK. Look for a label with a capital E in a circle to confirm compliance.

When car seats are not required

There are a few instances when your child is exempt from using a car seat, so it’s a good idea to get familiar with the rules when you’re out and about exploring with your family.

1. Taxi or Minicab

You can travel with your child in a taxi or minicab without a child car seat, but wearing an adult seatbelt, as the driver is not required to provide the correct child car seat.

Rules for travelling in a taxi:

  • Over 3 years old: must sit in the rear and use an adult seat belt.
  • Under 3 years old: must sit in the rear but must not use an adult seat belt.

2. Minibuses

Children can travel in a minibus without a child car seat. However, if neither a child seat nor an adult seat belt is fitted, they must sit in the rear seats of the minibus.

If child seats are not available or are unsuitable, children aged three or over must use an adult seat belt if one is provided.

3. Coach or Bus

Children can also travel in a coach or on a bus without a child car seat. However, on a coach they must use an adult seat belt if one is available.

Choosing the right car seat

When choosing your child’s car seat, you can pick between selecting a car seat based on either the child’s height or weight.

Height-based seats (i-Size)

Height-based car child seats are known as i-Size seats. These are the only types of car seats we stock at Halfords.

It’s important to note that if you use an i-Size seat and your child is 15 months old or less, then it must be fitted rear-facing with the airbag turned off on the passenger side to keep your little one safe and snug – this does not apply for weight-based seats.

When to move to a backless booster seat

A child can use a backless booster seat when they are:

  • Over 22kg, or
  • Taller than 125 cm

However, high-back booster seats offer better head and side protection, which is especially important for younger children with developing bones.

High-back boosters are suitable for children 15-36 kg.

Should you buy a used car seat?

Second-hand car seats may be inexpensive, but their history is unknown. They could have been involved in a crash, which might have compromised their safety and structural integrity, leaving your little one at risk.
